Small Claim

  1. If the request has been placed by the cardholder prior to any document preparation within a 48 hour period a refund will be issued for all services, EXCEPT  part of the document preparation fees.
  2. If the request has been placed by the cardholder after document preparation, regardless of the amount of time elapsed, a refund will be issued for court filing fees ONLY.
  3. If the request is placed after the documents have been filed NO REFUNDS WILL BE ISSUED TO THE CARDHOLDER.
  4. If the cardholder requests a refund because a Judgment was not entered in their favor NO REFUNDS WILL BE ISSUED, AS SMALLCLAIM.COM IS NOT RESPONSIBLE FOR THE OUTCOME OF ANY HEARING.
  5. If the cardholder requested their order be placed on hold and then later requested a refund they will not be eligible for a full refund, they will ONLY BE ELIGIBLE FOR A REFUND OF COURT FILING FEES IF THE FILE WAS PLACED ON HOLD BEFORE FILING.
  6. If the cardholder was required to NOTARIZE the forms and these were never returned to our staff to continue with the filing, the CARDHOLDER will NOT BE ENTITLED TO ANY REFUND IN THE EVENT THAT THE CARDHOLDER REQUESTS ONE.
  7. If the cardholder requested courtesy research on the defendant, smallclaim.com is not liable for errors on the naming of the defendant and therefore a correction can be made on the forms upon clients request PRIOR TO FILING, once documents are filed additional fees will be charged and NO REFUNDS WILL BE ISSUED. 
  8. If the cardholder requested research on the defendant and after decides to cancel the order, THE CARDHOLDER WILL ONLY BE ENTITLED TO A REFUND OF COURT FILING FEES ONLY. 
  9. If the legal action or motion was rejected by the court and the cardholder requests a refund, at that point they will ONLY BE ELIGIBLE FOR A REFUND OF COURT FILING FEES.
  10. If you placed an order for a skip trace and the results were not what you expected it does not entitle you to a full refund but only to the refund policy disclosed to you upon the request for this service.

All refunds are subject to evaluation and under no scenario is a client entitled to a full refund without their request being analyzed by a representative.

Process Serving

  1. If the request has been placed by the cardholder prior to the documents being assigned to a process server or within a 24 hour period of placing the order, whichever event occurs sooner, a refund will be issued for the serving fees paid.
  2. If the documents were filed by anyone other than SmallClaim.com and the cardholder did not provide a copy of them to SmallClaim.com NO REFUNDS WILL BE ISSUED TO THE CARDHOLDER, regardless of the amount of time passed.
  3. If the process server is unable to serve the documents due to the defendant not being available for serving, either personal or substitute as the law allows, at the address approved and/or provided by the cardholder NO REFUNDS WILL BE ISSUED TO THE CARDHOLDER, as serving cannot be guaranteed, only attempts at serving by traveling to the approved and/or provided address.
  4. Any one serving fee is only applicable to one address and one defendant and any additional defendants or addresses will require additional fees.

Dismissal Service

Skip Trace Service

  1. If the request has been placed by the cardholder prior to the skip trace being assigned to the skip trace department or within a 24 hour period of placing the order, whichever event occurs sooner, a refund will be issued for the serving fees paid.
  2. If our skip trace service is unable to find ANY information matching the person being searched for, the cardholder will be entitled to a refund of $25 ONLY, unless the cardholder was given a discount on the price of their skip trace.
  3. No other refund is available for the skip trace service.

All refunds are subject to evaluation and under no scenario is a client entitled to a full refund without their request being analyzed by a representative.

Postponement Service
