What are the steps involved in an uncontested divorce?

  1. We will professionally prepare your initial divorce documents.
  2. We will mail you the completed forms once you have approved the contents. Either you or your divorce attorney can then file the case with the court.
  3. If you and your spouse come to a mutual agreement on the issues brought up in the divorce, we can fill out the documents you will need for an uncontested divorce.

What are the steps involved in an uncontested divorce?

  1. After you file your initial documents with the court, you must have them served on your spouse. You will also need to serve your spouse with a blank Form FL-120 and file a proof of service with the court (Form FL-115). Your spouse will have 30 days to file a Response.
  2. Within 60 days after filing your case, though it can be done when you serve the initial documents, you must fill out Forms FL-140, FL-150, either FL-142 or FL-160, and all your tax returns from the preceding two years. You do not need to file these forms with the court, but you must have them served on your spouse.
  3. If your spouse files a Response to your Petition for Dissolution of Marriage, they must fill out and serve the same financial disclosure documents on you.
  4. Both spouses must file Form FL-141 with the court as proof of service of the financial disclosure documents.
  5. At this point, if you and your spouse can come to a mutual agreement on the division of your finances and (if applicable) custody of your children, you can file an uncontested divorce. Either one of you will need to fill out certain forms and file them with the court along with a written copy of your agreement.
  6. Once the court enters a judgment, your divorce is official.
